Dear Mr. Miller:
I am writing to tell you that I am very unhappy with the way my situation has been handled. After speaking to you on the phone yesterday, and letting you know that I had every intention of paying my bill, my service rep. Miguel was still charged for the total of my bill.
Not only do I think that charging the service rep for an account still in good standing is extremely bad business practice, but legally I find this practice somewhat questionable as well. My understanding is that this was done because the ticket had been open over a month. Apparently you did not look into it at all, as the majority of this time was taken up trying to diagnose the problem, and waiting for the district rep to come look at the car.
I have paid the bill, not because I feel it is correct or even justified, but to avoid putting Miguel through any hardship that is in no way his responsibility. Also, in this situation it should have been you who called to tell me your decision, rather than making Miguel call me himself.
I was informed that you would put me in contact with someone from Chrysler. Before this occurs, I need to have a letter from the district rep, or whomever denied my warranty claim, explaining in writing why my claim was denied and why they think Stage 1 had anything to do with it. According to the Maguson Moss Warranty Act, the burden of responsibility is on you to prove that anything I may have done to my car caused the failure of my engine.
Please take care of this with all expediency, as I have had my car down for two months now, and am extremely upset about it.
Sincerely,
Aaron Francis
Well, looks like I'll be canceling my appoint with Palmer now...Who is the contact for Hayes?PyroPVO said:Aaron, gimme a call - I've got Rick Dibble's cell number.
Rick is the South East Dealer -> Chrysler Corporate Management rep.
Check my response in the following thread: http://www.srtforums.com/forums/showthread.php?p=1197135&posted=1#post1197135bodizapha13 said:That sucks Aaron. I hope it works out for you. A letter should be sent by you or one of the other ATL types with the heading and/or title of Southeast SRTOC President and bring it to their attention that the actions of their business have not only affected who you will go back to but the many SRT owners in the area have been given the same information and will now be seeking help from other dealerships. Copies should make it to the over all manager, head of maint., and the owner of the dealership. Losing your business can be disregarded easily, losing the business of 20 other SRT's becomes a problem. I respect how you are accepting blame for the probs. with the car. Many others would not do it as classy. They are totally wrong for how they are handling the billing. I have never heard of such crap before. Power to the people's and stuff.
LoL thats funny.your cd player died too huh? so did mine, just quit playin cd's all together. I got it replaced and had em give me the new one uninstalled. Put the new one on ebay and bought an alpine. Then a crack head broke in and stole my alpine and the insurance company gave me more money than I needed to buy my origional alpine so I got a better alpine. and thats my story.
Charlie,
While I appreciate this note from you, it does not answer my questions. I need in writing the reasons why warranty service was denied, what you think caused the problem and why.
As the head of service at Palmer Dodge, I'm sure you are familiar with the Maguson Moss Warranty Act. Some of the points covered include installation of parts. "No warrantor may condition the continued validity of a warranty on the use of only authorized repair service and/or authorized replacement parts for non-warranty service and maintenance." This relates to the Stage 1 installation, which you mentioned would void my warranty in part due to the fact that it was not installed by a dealership.
It was also mentioned that having Stage 1 voided the warranty on my engine. Referring back to the same Act, warranty service can not be denied based solely on the installation of an aftermarket part. Please provide your reasoning and proof that this part caused the damage to my engine. Stage 1 is an Mopar part, extensively tested by the PVO team on SRT-4's before being released. I'm sure if it is capable of causing complete engine failure, it would not have been released to the public.
When my vehicle was originally brought in, it was discovered that the turbo bearings had failed, dumping a large amount of oil into my engine and exhaust. The bearings were replaced, but the car still smoked extensively and did not run right, as was discovered when I test drove it again with the service rep. in the car. Is it possible that excessive oil in the combustion chambers (which would not compress like air) caused ring failure and thus the resultant damage to the engine? The mechanic working on my car at Palmer said the problem was an exhaust leak, and as such the car was driven to another shop to be fixed, then had to be returned to the dealership when this did not fix the problem. This is a possible theory which was brought up by the mechanics looking over my car.
Also, related again to our phone coversation, I resent the implication that I race my vehicle. It was a completely unfounded comment, and I would appreciate it if in the future you would refrain from making such implications. I look forward to hearing from you with the requested information.
Thank you,
Aaron Francis
