A lot of guys just remove them without any major issues that I know of. I'm sure you'll be fine with a modified one. Better off than removing it completely.

Modify or remove the lower heat shield shouldn't be a problem, I'm thinking the upper is more important.

I removed both heat shields 70K miles ago for a quicker turbo cool down. There is less carbon build up (coking) on the turbine side of the shaft without the shields. The only downside is that I like to pop the hood when I park in my garage, for cooling air flow.
