Got a ticket

Ok so I was cruizin on US 60, hell I have no idea exactly fast I was going, I believe it was 75 as I was trying to pass someone.
So I chill pass the dude, 2 exits later I get off at my exit and I see flashers in my rearview. I'm like wtf is this, what thell did this come from

So I get off the ramp and park in a parking lot, and there are 2 cops with guns pointed at me. I turn off the vehicle and put the keys in the passenger side seat, where the 2nd cop was standing. I had the turbo timer on and they kinda looked there and did a

Ne ways he tells me I cut the guy of and didn't signal (which I did signal) so then he goes, "I was pacin some other guy and I saw you cut a person off, and didn't signal". I asked how fast I was going and hes says about 90'ish. I was like umm I was pasing a guy on the freeway, I wasn't looking at the speedo.

So I asked how did you know I was speeding, he said he was pacing me... Ok is this going to hold up in court.

How can a cop, claim you were speeding by using pacing as a method to determine speed? He wrote on my ticket 85+ and had paced me, he didn't write an exact speed.

That and he asked what the guage was on the dash, I told him it was a boost gauge, and he said "Whats it do". o*&^%$# retarded cops.

What should I do.

if they pulled you over for cutting a guy off without signaling, then why did you get a ticket for speeding? it doesnt make sense
Thats what I said, and why didn't they pull me over on the freeway...

It took 2 exits before they did, and didn't turn on the flashers till I got off.
u shlda got their badges, slapped their bitch @ss, then taken a beating like the man u are. then i'd watch that jont on america's dumbest criminals.

didnt SCC have an article about this? i've been looking for it ever since i threw it out. i think u can walk, but u'll have to appear in court. there's some group where u can download instructions on how to walk on that b.s.

i'm not downing cops, cause, for real, they save lives. but i think they shlda let u off w a warning & let u walk--based on what u've written.
Thats what I'm saying, they didn't have an exact speed and it took them forever to flash me.

Also, I have 0 tickets and 1 not at fault accident on my driving history, what would a judge say about that.
dude i got one for going 98 and the sob was hiding he was cool about it and was complaining cause i hadnt put my plates on. that was #4 ticket I got to fight I have to win someone give me some advise on how to beat thisone
vanilla & rice: if u still have old scc mags from mid to late 2002, search the editor's section. they were talking something about your right to request calibration reports from radar detector, and that crap actually being available for you before your court date.

vanilla. u gotta wonder what the chances are of the cops appearing @ court, i think. i'll look for the organization that helps folks that have tickets online. both of y'all's stories seem like there's a CHANCE to walk. i'm not a lawyer, neither do i play one on tv. but i'm looking @ the odds.

if u show up for court & lose, tho. u dont get a chance to remove the points & gotta pay mucho dinero para su ticket.

I foaght one before and lost the cop shows up your done but the judge was cool and gave me traffic school again
hell, yeah. the gun jont blew me, too. wtf. u really got a chance to walk now. their suspicions were WAY above reality.
I say fight the ticket in court and explain exactly what happened. Ask the judge to ask the officer how fast you were going then ask if he clocked you or not. Then state how the ticket wasn't for what they pulled you over for, thus making the pullover void. Seek somemore advice on this but that's what I say.

They always draw their guns on my :roll: They searched the car and shizzat too.

I like the idea of if he clocked me, or not. I know some people are saying it will hold up in court. As for changing the ticket to speeding instead of without signaling, I don't know how I could contest that, its not in writting.
an unsafe lane change is the same as a speeding ticket in cali.

The Ticket

Cops get annoying FAST. Yeah they can pace you, some call if pacing some call it bumper pacing either way the cops word usually holds up in court. They should have never drawn they're weapons unless engaging in a high risk or felony stop. I will go out on a limb here and say you have a somewhat decent chance of fighting this ticket if the officers acted in the way they did. The courts always give police officers the benifit of the doubt so you need to just present yourself and explain yourself as best as possible. Most traffic stops I have been in we never used a radar nor did we even pace after a while you just get a nack for 'guessing' the speed some one is going and you tell them that you paced them doing that speed. He was probably too far behind you to pace you properly anyway. Best of luck to you in court I think you will be able to get out of a ticket like this!

Most officers in california gets paid for 4 hours of work when they have to appear in court even though most court sessions take less than an hour of time. LEO's live for court its a paid 3 hour break. Chances are the ticketing officer will show up espicially if its CHP.
I believe they pulled their weapons due to the nature of my so called speed. The officer said he was pacing someone esle, saw me make a lane change without signaling (I used my friggin signal). He said the other guy was going 90'ish, the guy they were pacing, and yeah they were a ways behind me.
Grr the AZ texers are saying it will hold up, no matter what the orginal terms were for being pulled over.

I guess its off to traffic school.

Did you consent to they're vehicle search. They cannot search your can unless they
A) Arrest you and perform a search.

B) Have PROBABLE CAUSE to to believe that you were engaged in criminal activity and that there is evidence of criminal activity in your car (Carroll V United States also the Carroll Descision)

C) You consent to a search . . and no a consent is not a submission to authority.
D) there are of course exceptions like the public safety exception but that isnt a factor here.

I can list court descision after desicision. . . what they did (if they did as you described) was so clearly a gross violation of your fourth amendment rights. They are sworn officers they know better than to expoit the ignorance of the populace regarding law. You need to file a complaint or talk to some one more firmiliar with Arrest search and seizure than me. Some one correct me if I am wrong (I am not too rusty on this topic) but I am almost 100% sure

Thats the weirdest thing I have ever heard. I have never been in nor heard of a situation where guns were drawn for any type of normal traffic stop. We give officers alot of discretion but they should NOT draw firearms unless its a high risk or a felony stop, and a ticket for 85 and an unsafe lane change is definatly not high risk nor felony. Whether he was in the wrong or not what he did was definatly not standard operating procedure.
I don't know man, thats twice its happened to me in AZ, the last time they searched my car, the officer saw a twig, and cliamed it to be weed.

Yeah, they officer didn't know my exact speed, claimed he was going 90 when he saw me do the lane change.

The AZ'ins are saying I have no chance getting off, its my word against the cops, and there were 2 of them.
