Default What would you do?

So the story goes like this. The story is 100% true and I will be changing the names of everyone involved except myself just so there are no hard feelings. The three people involved are myslf (Mike), "Jeff" and "Jeffs" brother "Walter"

Here we go.....................

So Jeff's brother walter has a carbon fiber hood for an SRT-4 that he is trying to sell, Jeff tells me that his brother wants $400 for said hood and I agree to buy it. At the time of purchase (sometime in February) I didnt have all the funds so Jeff's brother allows me to give him half the money for the hood and half later. I go to Jeff and Walters house to put the hood on the car and after swapping hoods I realize that I cant fit my factory hood back in the car. I chose to leave my factory hood at their house with the permission of Jeff who says that the hood will be safe their and I can come get it when I have a truck and the ability to come get it. So about two weeks later I get a call about an awesome job that requires me to spend 99% of my time on the road, I take this job and travel to California for all of March-July only coming home for a 2 week period. When I come home in July, I call Walter to make arrangements to bring him the other $200 that I owe him and pick up my hood. Only to be told that my hood isnt there.......Walter says he never even knew I left it their and Jeff says that his dad probably threw it out. A few days later I ask Jeff and Walter if they have found my hood and both of them start in about how its not their responsibility to know where my hood is and that if it was that important to me I would have came and picked it up sooner. (maybe, but I cant pick a hood up from 2400 miles away)

There is lots more to the story, but it is all bickering, name calling and finger pointing and has no baring on the story itself.

Now I am a pretty reasonable person, and I am still going to give Walter his other $200 for the hood because regardless of the situation, that is the right thing to do.

The question is, should I press charges of some kind about my hood or should I let Karma handle the situation at some point?

keep the $200, and tell them when they "find" your hood, you will pay the rest.... and give them a 30 day time frame. If they don't have your hood in 30 days, you keep the $200 and the deal is done...no hard feelings. An srt hood is pretty hard to miss in a garage so I doubt walter never saw it and is NOT easily thrown away...you can't press charges, you left it there and it disappeared. You have no way to prove anyone took it so the police won't do anything.

well judging these people are not obvious good friends of yours, i would say your SOL...you should have grabbed the hood earlier...not taking a shot, but if someone left a part at my house for 4 montsh i wouldnt feel responsible if someone else in the house through it out...

Sorry man, think you should have gotten it in a reasonable time frame...

But imo it sounds like he sold it or something happened to it and neither of them want to take responsibility.
Easily keep the money man, I realize it the 'right thing' to still give the money but why give the satisfaction to someone who is trying to get away with something? They will never learn. That of course if my throey is right =/

You still had 2 weeks to pick up your hood, that is plenty of time. Also, it was pretty shitty of you to wait 5 months to pay the guy the other $200. Your friend agreed to let you keep the hood there temporarily, thats it. I'm sure he didn't say he'd safeguard it with his life.

IMO, you are in the wrong for taking your sweet ass time.

Ah good point, but then couldn't you make the argument that the seller should have set up a time frame for payment? Or buyer should have setup a time frame to pick up said hood.

I am sure he had your phone number or forum name? If that is the case someone should have reminded you the hood was there and called or sent a message before throwing it away. I would not pay him since he probably sold it to cover the 200. Who cares how long it took to pay there was no set time frame the payment had to be made. The only time I would throw something away is, if I told you to come get it and you just decided to blow me off and after I called and reminded you again.

An SRT hood fits perfectly in the back seat....so I dont know why ya'll couldnt fit it.

Just keep the $200 and the c/f hood. More than likely they sold the hood because you took too long to pay the remainder and failed to pick up the hood in timely manner.

I think you should give them the 200 and suck it up as a loss. I understand that you weren't around to pick up your hood, but you could have gotten it somehow. You said you came home for a two week period, there is 14 days that you could have gotten it. I'm assuming these kids live with their parents, if my kids had someone's car parts on my property for almost half a year, I'd assume it was abandoned and trash it too. You don't know that the kids sold it to cover their loss on the 200 (that you took entirely too long to get to him). You're lucky they didn't go back to your car while you were away and take the hood back and leave you 200 dollars in monopoly money.

you mean all this time i was using monopoly money and its no good?? haha! yeah, i think you took too long to retrieve the other hood, in a way i dont blame them, but at least they could've been honest with ya and told you what they did with it, sold it to cover lost funds..etc.

I would be half way in the middle. I would want to pay them cause I'm a pretty honest guy but at the same time, I would want my stock hood lol.

I would post a message in the WC section of a forum and ask what to do...
