Default Any possibilities of fighting this?

Ok, so I was out tonight with my friend, and we were coming back from watching Spiderman 3 (great movie btw... ) but anyways, we are getting on the freeway, so I decided to show him what size balls the ole' SRT has, and on the on ramp, I got it up to about 100 by the time I as actually on the freeway. So were cruising along, and I see parking lights, and thought, oh fuck, thats prolly a cop. So I slow down to 55, and he pulls out and puts on his sirens. I pull over, he tells me he knows I was going much faster, but he could only clock me at 81 in a 55. He was a cool cop, I'll give him that. But anyways, so I now have a ticket for an 81 in a 55, and am wondering if there is any way to fight this? And how would I go about doing it, or would it even be worth it? I have a clean slate right now, no tickets, no written warnings, nothing. I'm not to worried about the actual ticket, I just don't want my insurance going up any more than it already is for a 19 year old... lol. But yea, any advice would be GREAT. Thanks guys.

Go fight it anyways. To be honest, the chances of you getting off scott-free are slim, but you will more than likely get the ticket reduced if you fight it. Our court systems are so congested in Ontario(Canada), this lady that totalled my car got off a careless(6 points, $375) because the court date she was given was over the 10 month limit(hers was 15 months from the accident date).

You could always get lucky, chances are if the cop doesn't show you'll get off, but even if he does you'll be better off with the reduced ticket.

well what exactly is involved with "fighting" a ticket? as stated, i have never gotten one before, so i am unaware of the system. i dont have any hard feelings against the cop, cuz he was pretty nice, but if anyone could let me know what exactly happens when going to court for a ticket, that would be awesome. preferably someone from ohio, just for my own referrence's sake, but any other advice would be cool too.

I can imagine the procedure is similar.

Go to the courthouse, to the counter where you'd pay the ticket, tell them you'd like to fight it, they'll give you a court date. Show up on the given date, listen to them talk about your ticket along with like 40 other people. They'll ask you to stand when it's your turn, ask you how you'd like to plead, say guilty, then they'll reduce your charge(95% chance atleast).

Although, I think I've heard before that you guys in the US are given court dates at the time of the ticket... However, I can't confirm that.

Okay where should I start, Fighting a ticket in ohio is kind of pointless, He had a clock on you, and the fact that he is going to tell them that you were slowing down they really are not going to want to help you out, but if you want to know the process, show up to court on your court date and tell them you want to plead not guilty, then they will tell you to go home and they send you a paper in the mail with your next court date, this is when the prosecting attourney looks at the case and you go in front of him and the judge, if the prosicuting attorney feels he doesnt have a case against you he will offer you a plea bargan type of reduction to throw the case out, if you want you can chose to go back to court and tell your story to the court but the cop is going to testify against you and they have to chose between a 19 year old kid in a sports car and a "man of the law" with a radar gun, so then you are going to lose and have to pay the ticket and court cost. some tickets are worth fighting and some arnt, and a speeding ticket isnt unless they give you a ticket without clocking you, sometimes you can fight a ticket when you get an accident or even a street racing ticket in the right cases but not speeding tickets, sorry

your only hope is the cop doesnt show up to court on your 3rd visit to court and they will throw the case out, but the chances of that happening are very slim to none

most systems if you go in and plead no contest (which means you neither plead gulity or innocent) they usually take it down to the lowest possible fine/points. i got a ticket once (my only one) in WI for 26 over on the highway, went in plead no contest and only got 3 points and the fine for doing 9 over (both of which were the lowest possible fine) otherwise it would have been 7 points and reckless/street racing fine, here in MI you can do the same but you can opt to pay a higher fine to not get any points

Next time you get pulled over and they say they clocked you. Ask to see the radar gun. I got pulled over last tuesday. I asked the cop to see the radar gun to prove I was speeding (which I was). He said he cleared it, so I asked then how do I know you clocked me? He let me off with a warning.

There's a statute here you can plead to that gives you no points but a bigger fine (couple hundred $). You can only use it 3 times, each time the fines get bigger. After the 3rd time they will literally nail your ass to the wall, rape you with several nightsticks, then back-charge you for the original 3 incidences. Basically, don't do that.

I'm pretty sure Ohio is the same as Indiana. Just call and ask if you can defer the ticket. No points will be on your license and the insurance will never see that you got a ticket. However, you will pay a much larger "fine" and you must remain ticket free for one year. If you screw up again in that year, then you must pay both tickets and the points will then go on your license. No point in fighting the ticket, I've tried it and it doesn't work.

By the way, those jammers are a joke and a waste of money. Do some research and you'll see what I mean.
