Last we checked we actually weren't in the Twilight Zone, but quite frankly, the bigwigs at Gibson just might be. Seemingly out of nowhere, the famed guitar manufacturer sparked up a lawsuit against Activision claiming that Guitar Hero titles violate one of its patents. Now the company appears to be on the warpath, suing Wal-Mart, Target, GameStop, Amazon, Toys 'R' Us and Kmart in an attempt to get the game off of store shelves. Reportedly, Gibson took "this action reluctantly, but is required to protect its intellectual property." For the retailers that did comment, they chimed in only to say "we aren't commenting," and judging by the looks of things, the games are still widely available -- for now.

love the guitars, have a few myself but this is just ridiculous. they went after PRS a few years back for their single cut design, claiming it infringed on the almighty les paul models. i thought that was the height of their idiocy but apparently i have much to learn.

UPDATE!!!: CHECK THIS SHIT OUT, now there making a SECOND lawsuit against MTV Networks, Harmonix, and Electronic Arts for developing, distributing and promoting the video game Rock Band, saying they are violating a VIRTUAL-REALITY patent the guitar maker holds. Here's the story on YAHOO!

Gibson did the same thing to ESP for using the Explorer body style.
forgot about that. granted, didn't gibson have the explorer modeled after the Futura prototype? saw a reproduction of one bring 90k on auction a few years back.
GIbson has a facility here in Nashville. I've noticed for years that they were always advertising for in-house counsel, either general or assistant. I just checked and they posted an ad about a month ago looking for an assistant in-house counsel. They can't even keep lawyers. I'm sure they're hell to work for in any capacity.
going by the specifics of their VR patent,
A copy of the patent included in Gibson's lawsuit is dated Nov. 23, 1999, and describes a device that lets a user "simulate participation in a concert by playing a musical instrument and wearing a head-mounted 3-D display that includes stereo speakers."
doesn't sound like guitar hero or rock band. they list a musical instrument, not a game controller. also neither game incorporates a "head mounted 3D display that includes stereo speakers"
i don't think gibson has a foot to stand on here. they got paid for their name in the game, but this VR nonsense is gonna start giving them a negative image.
