You probably will not be sniffed. They will check to see if you are throwing codes from the OB port. But this is Wa. St. better to register your ride in a county with no emissions if you are concerned about modding.
When I took a car to emissions in King County during 2005, they plugged into OBDII and they sniffed. This was for an 01 Mercedes. Can't tell you if that cat will pass or not. Every state is different. I would just go catless and swap stockers back in when you do have to test. It's only once every whatever years anyway.
if it were me i wouldnt go in with a side exit...just cause with the noise and stuff who knows what fancy idea they might get in doing the emissions or anything else...you know? maybe they might be curious about your noise decibals
PTP sells a 10" diameter peice of drain pipe that bolts up to the stock O2 pipe for a side exit, it's a little rough on the road turtle's but will easily be cooler then COY's tiny 3"
